GANNETT ADDITIONAL TERMS FOR UNTESTED PODCAST
These Additional Terms (“Additional Terms”) apply to your access to season one of Gannett’s Untested podcast series (the “Podcast”). The Additional Terms include the Gannett Terms of Service (Gannett Terms of Service), and any other documentation, policies or guidelines that we may provide in writing. Capitalized terms not defined below will have the meanings given to such terms in the Gannett Terms of Service.

BY SUBCRIBING TO THE PODCAST, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE ADDITIONAL TERMS AND OUR PRIVACY POLICY (Gannett Privacy Policy), which describes our privacy practices in detail and is incorporated herein by reference. Please read them carefully.

We may modify these Additional Terms and encourage you to check back here from time to time for any modifications we may make to these Additional Terms.

1. Ad-free Access to the Podcast
We provide the Podcast using The Slate Group, LLC, d/b/a Supporting Cast (“Slate Group”) service for premium podcasts. Slate Group shall also provide customer support for the Podcast which can be reached via email at: help@supportingcast.fm. We grant you a limited, non-sublicensable, non-exclusive, non-transferable license to ad-free access the Podcast for your personal and non-commercial use during your Order (as defined below), and only in accordance with these Additional Terms. The Podcast is available for the non-commercial use of end users only and is not available for purchase or use by resellers.

2. Order, Fee and Billing
2.1. Order. Ad-free access to the Podcast shall be provided to end-users on an annual basis (“Order”).

2.2. Cancelling Your Order. You may cancel your Order at any time by signing into your Slate Group account and following the cancellation instructions provided, and cancellation will be effective at the end of the applicable Order period during which you notify us of cancellation. If you cancel your Order, you will still have access to the Podcast for the remainder of time you have already paid for, but you will not receive a refund. You will also forfeit any service or referral credits upon cancellation. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL ORDER, EXCEPT AS STATED HEREIN OR OTHERWISE REQUIRED BY APPLICABLE LAW.

2.3 Fee. We charge a one-time annual fee for your Order (the “Fee”). The Fee payable is clearly displayed during the ordering process. You can find the specific details regarding your purchase and pricing at any time by accessing your Slate Group account for the services; specifically, by visiting the Slate Group website and clicking on the "Dashboard" link available at the top of the page of the page, under your profile name.

2.4. Billing. By providing a credit card, debit card or other payment method (“Payment Method”) for the purchase of your Order, you expressly agree that we, our affiliates or a third-party payment processor is authorized to charge you the Fee (plus any applicable taxes). The Fee is nonrefundable unless otherwise stated in these Additional Terms. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE THE PAYMENT METHOD YOU PROVIDE.

3. Cancellation, Modification and Suspension of services
3.1. Cancellation. We reserve the right to discontinue ad-free access to the Podcast at any time. In such an event, we will provide you with a prorated refund of any prepaid Fee based on the remaining time of your Order. We also reserve the right to suspend or terminate your ad-free access to the Podcast in our sole discretion without prior notice if you fail, or we suspect that you have failed, to comply with any of the provisions of these Additional Terms.

3.2. Modification. We reserve the right, in our sole discretion without prior notice, to modify suspend or discontinue the Podcast. The availability of content offered at the time you register for access to the Podcast may not reflect the content that will be offered throughout or from time to time.

3.3. Termination. When your Order ends, you will lose ad-free access to the Podcast.

4. DISCLAIMER OF WARRANTIES.
NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE PODCAST IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PODCAST IS PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE PODCAST AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. FURTHERMORE, WE DISCLAIM ANY WARRANTIES AND CONDITIONS WITH RESPECT TO SERVICES PROVIDED BY THIRD-PARTIES. YOU ACKNOWLEDGE AND AGREE THAT WE ARE NOT RESPONSIBLE FOR YOUR USE OF ANY THIRD-PARTY SERVICE AND WILL THEREFORE NOT BE LIABLE FOR ANY HARM OR LOSS ARISING FROM YOUR USE OF SUCH THIRD-PARTY SERVICES.
